Allen Child Support Attorney

At the law firm of DePlaza & O'Connor, our understanding of Texas child support laws gives us the ability to analyze our clients' circumstances, factoring in the other parent's circumstances and the child or children involved to see whether the Texas Child Support Guidelines will adequately meet the needs of any children. If they do not, we may be able to make a convincing case for raising or lowering the amount of support to be paid.

In Texas, judges have the discretion to depart from Child Support Guideline amounts and to raise or lower the amount of child support to be paid or received. When departing from the Guidelines, judges consider certain factors, which may include the following:

  • Other children: Judges consider a parent's responsibility for a child (or children) from a previous relationship
  • Errors or misrepresentations in reported income: Judges make sure that gross and net income disclosures are accurate for parents who are self-employed, seasonally employed or whose incomes are subject to predictable fluctuations.
  • Children's daily needs: Judges consider the specific needs of the children to be supported — not only food, clothing and shelter, but also expenses for health and medical care, sports and other activities, counseling services when necessary, tutoring, academic enrichment or other needs.
  • Mental and physical disabilities: Judges take into account the ongoing needs of children with mental or physical disabilities beyond the 18th birthday or high school graduation.
  • Future reductions in earning power: Judges anticipate projected reductions in a parent's earning power based on a medical condition, disability or economic forces in certain industries.
